Accommodation Terms and Conditions

(Application Scope)

Article 1: Accommodation contracts and related agreements concluded between our facility and guests shall be governed by these terms and conditions. Matters not stipulated herein shall be governed by laws and regulations or generally established practices.

2. Notwithstanding the provisions of the preceding paragraph, in cases where our facility agrees to a special contract that does not violate laws, regulations, or established practices, such special contract shall prevail.

(Application for Accommodation Contract)

Article 2: Persons applying for an accommodation contract with our facility are requested to provide the following information:

(1) Guest name
(2) Date of stay and estimated time of arrival
(3) Accommodation fee or credit card information acceptable at our facility
(4) Other information deemed necessary by our facility

2. If the guest requests to extend their stay beyond the originally scheduled dates during their stay, our facility will treat it as a new accommodation contract application at the time of the request.

(Conclusion of Accommodation Contract)

Article 3: The accommodation contract is deemed concluded when our facility accepts the application as specified in the preceding article. However, this shall not apply if the facility proves it did not accept the application.

2. Upon the conclusion of the accommodation contract, a deposit determined by our facility must be paid by the date specified by the facility as a part of the basic accommodation fee.

3. The deposit shall first be applied to the final accommodation charges, then to penalties under Articles 6 and 18, and any remaining balance shall be refunded upon payment of fees under Article 12.

4. If the deposit is not paid by the designated date, the accommodation contract will lose its effectiveness.

(Special Contracts Not Requiring Deposit)

Article 4: Notwithstanding the provisions of Article 3, paragraph 2, our facility may accept a special contract not requiring a deposit after the contract has been established.

2. If our facility does not request a deposit or designate a due date when accepting the accommodation contract, it shall be treated as a special contract.

(Request for Cooperation with Infection Prevention Measures)

Article 4-2: Our facility may request cooperation from potential guests regarding infection prevention measures in accordance with Article 4-2, Paragraph 1 of the Hotel Business Act.

(Refusal to Conclude Accommodation Contract)

Article 5: Our facility may refuse to conclude an accommodation contract under the following circumstances:

(1) When the application does not conform to these terms and conditions.
(2) When rooms are fully booked.
(3) When staffing is insufficient to provide appropriate service.
(4) When the guest is likely to engage in acts against laws, public order, or morals.
(5) When the guest is found to fall under any of the following:

i. Organized crime groups, members, quasi-members, or related persons.
ii. Organizations or companies controlled by such groups.
iii. Companies with executives who are members of such groups.

(6) When the guest has caused significant disturbance to other guests.
(7) When the guest is a patient with a specified infectious disease as defined by law.
(8) When the guest makes violent demands or requests beyond a reasonable scope (excluding socially justified requests based on disability discrimination law).
(9) When the guest repeatedly makes excessive requests that hinder services to other guests.
(10) When accommodation is not possible due to natural disasters or unavoidable circumstances.
(11) When the guest is intoxicated or unclean in a way that may disturb others (per Kagoshima Prefecture regulations).

 

(Guest's Right to Cancel the Contract)

Article 6: Guests may cancel their accommodation contract by notifying our facility.

2. If the guest cancels due to personal reasons, cancellation fees will be charged as listed in Appendix 2, except for cases where the deposit was not requested.

3. If the guest fails to arrive by 7:00 PM on the day of arrival (or 2 hours past the designated arrival time), our facility may deem the contract canceled by the guest.

 

(Facility’s Right to Cancel the Contract)

Article 7: Our facility may cancel the accommodation contract under the following circumstances:

(1) If the guest is likely to or has committed acts against laws or public morals.
(2) If the guest is involved with organized crime, related organizations, or individuals.
(3) If the guest causes significant disturbance to others.
(4) If the guest is a patient with a specified infectious disease.
(5) If the guest makes violent demands or unreasonable requests.
(6) If the guest repeatedly makes excessive demands hindering other guests’ services.
(7) If accommodation is impossible due to force majeure.
(8) If the guest is intoxicated or unclean in a way that may disturb others (per Kagoshima Prefecture regulations).
(9) If the guest smokes in bed, tampers with fire equipment, or disobeys safety-related house rules.

2. If the contract is canceled under the preceding items, no charges will be made for services not yet provided.

(Guest Registration)

Article 8: Guests must register the following at check-in:

(1) Name, address, and contact information.
(2) For foreigners without a Japanese address, nationality and passport number.
(3) Other necessary items designated by our facility.

2. Guests paying with non-cash methods must present the relevant means at the time of registration.

(Room Usage Time)

Article 9: Rooms may be used from check-in time to check-out time as specified.

2. Extensions may be accepted with additional charges:

(1) Up to 3 hours: 30% of room charge
(2) Up to 6 hours: 50%
(3) Over 6 hours: 100%

(Compliance with Rules)

Article 10: Guests must comply with the facility’s rules posted inside the premises.

(Business Hours)

Article 11: Main service hours are as follows. Details will be shared at check-in.

(1) Front Desk: 16:00–19:00

2. These hours may change in case of necessity and will be announced appropriately.

(Payment of Charges)

Article 12: The breakdown of charges is listed in Appendix 1.

2. Payment must be made in cash or other approved method upon departure or when requested.

3. Charges will apply even if the guest chooses not to stay after using the room.

(Liability of the Facility)

Article 13: The facility is liable for damages caused to the guest due to breach of contract unless due to reasons beyond our control.

(If Room Cannot Be Provided)

Article 14: If the reserved room cannot be provided, we will try to find equivalent accommodation.

2. If no arrangement can be made, a compensation equivalent to the penalty will be paid unless the situation was not due to our facility's fault.

(Handling of Deposited Items)

Article 15: In principle, we do not store guests’ belongings. If stored, we are not liable for damage or loss.

2. If belongings not deposited at the front are lost or damaged due to our facility’s fault, compensation will be up to ¥50,000 unless declared in advance.

(Handling of Luggage/Personal Items)

Article 16: If luggage arrives before the guest and we have agreed to accept it, we will store it responsibly.

2. If items are left behind, we will contact the owner if known. If unknown, they will be kept for 7 days then delivered to the nearest police station.

3. Our liability for such items shall follow Article 15 accordingly.

(Parking Responsibility)

Article 17: The facility provides parking space but is not responsible for vehicle management.

2. If we park on the guest’s behalf and damage occurs, we are not liable.

(Guest Responsibility)

Article 18: Guests are liable for damages caused intentionally or negligently to the facility.

(Payment of Fees Schedule 1 Breakdown of Accommodation Fees, etc. (Related to Article 2, Paragraph 1 and Article 12, Paragraph 1)

2. In the event that the tax law is revised, the revised provisions shall apply.
